View Full Version : PLEASE HELP! Being evicted from sublet in New York City?

My brother rented an apartment in New York City from a lady for 2500.00 a month. The apartment is rent controlled so she only pays 1600.00/month and pockets the rest...which is of no concern. The problem is she has a friend who wants her apartment so now she is asking him to move out by Jan 1st...he received the letter yesterday, Dec 22. There's no way he can find a place in tha time, especially with the Holiday week coming. He asked her numerous times for documentation since he movied in August, '07...receipts, a letter showing tenancy...which she said she would provide but never did.

Can she evict him with only 5 business days notice? Does he have any recourse?

has he other bills showing that he was living there like electric gas ,phone anything if so take her to court that gives you more time call a lawyer she can not throw you out in 1 or 3 days you need to call the sheriff and find out the law....I have been evicted and it went on till 3 months with being tossed over a argument keep putting your rent in bank so it shows you are not welching on rent..

if he didnt sign a contract then she can evict him but by law she has to give him a 30 days notice at minimum.

She is required to give 30 days written notice.
